Argentina’s Supreme Court Lifts Limits on Foreign Ownership of Rural Land

Court reinstates Milei’s 2023 repeal of the Rural Land Law, opening Argentine farmland to international investors
BUENOS AIRES, Argentina, 29 September 2026 – Argentina’s Supreme Court has issued a ruling that removes the limits on selling rural land to foreigners. The decision puts back into force a key article of President Javier Milei’s 2023 mega-decree, according to La Nación.

The ruling covers Article 154 of Decree of Necessity and Urgency (DNU) 70/2023, which the Milei administration issued in its first weeks. That article repealed the Rural Land Law and the foreign ownership caps it set. A lower court had suspended it after the Centro de Ex Combatientes Islas Malvinas La Plata (CECIM), a group of Falklands/Malvinas war veterans, challenged it as unconstitutional.

What Changes

The Rural Land Law (Law 26.737, passed in 2011) placed strict limits on foreign buyers. These included a national cap on the share of rural land foreigners could own, limits for each nationality, a maximum size for individual foreign holdings in core farming areas, and restrictions on land that contains or borders major bodies of water. With the Court’s ruling, those limits no longer apply.

Why It Matters for Investors

• Wider access: Foreign individuals and companies can once again buy Argentine farmland, cattle ranches, forestry land, vineyards and estancias without the old caps.
• Clearer rules: The decision ends the legal uncertainty that had held back cross-border land deals since 2023.
• Market momentum: Together with Argentina’s broader deregulation program, the ruling is expected to bring new interest in agricultural and rural assets from buyers in North America, Europe, Oceania and elsewhere in Latin America.

Buyers should still get independent legal advice. Border security zones and other rules may still apply, and the political and legal debate over the repeal is likely to continue.
